Are you planing to add a setting to the dats that determines if the CHDs belong in folders or in the roms folder?
Zinc and the new clrmame version have this issue (clrmame wants the chds in folders but Zinc does not)/

There is no issue. The official storage procedure of chds is rompath\setname\chdname. MAME always did it that way. Storing chds in a pure romfolder was possible due to a MAME bug (see mame whatsnew.txt) and never was officially supported.
If zinc allows chds in a pure rompath, you can still toggle the chd related option in scanner->advanced.
