DS only though, as already pointed out the 3DS isn't busted. This actually goes back to the DSi though with dsiware as a piracy lockdown test bed. Notice there's no real warez out there for dsiware titles or virtual console roms? They took a lot of lessons from the DS being busted open and invented a few things and revised it even more heavily with the 3DS and its eShop.

Basically they have that RSA encryption again, 128bit, which DS had. The DSiware and 3DS/eShop though are more advanced in that they went deeper with unique codes per game where the system can poll the data and see if its legit. I have not dug too deep to see if someone figured out how to break the encryption on games saved to the SD cards, but I've never seen a big press fubar thing going on crying about it so I doubt it. As stated that story of the 1:1 copying of a 3DS card is likely bullshit, or at least partly which means bullshit still even if you get 1/2 the data and fake fill the holes.

I'm actually pretty happy Nintendo figured out what everyone else so far has grossly failed to do. I can only imagine what even deeper steps they'll do with the WiiU, perhaps 256bit encryption, random codes, and another set of lock and key to screw with people. It's hard to say, but they seem to for all the whiny pirate taunting have figured out how to screw them over fairly well.
