No, it isn't against the license. The license is pretty much "do what you want as long as you give back the source and don't make money out of it".

I'm not surprised. Writing fast emulators is hard, speed hacks tend to be one game only, and the reward, unending abuse by whiners who want more more more, is not worth it.
