I believe that's just so when people sell arcade machines filled with roms + mame, the mame team isn't held responsible and can use their EULA in court to try to dismiss claims. I think there are loopholes in copywright laws that could get the mame team into a lot of trouble anyway but I think there's too many people who don't want to get mame into trouble out there because they understand these are just independent people not making money off their work.
